My
signature means that I agree to the Conditions on the reverse side of this
form, and consent to, and accept this written notice of your obtaining a
credit report or other information about me from any person. I also agree
to the ongoing collection, use and disclosure of information relating to
me as set out in the conditions and in the credit card agreement relating
to my account.
I
certify that the information given above is true and correct and by
signing below, I accept as notice in writing of, and consent to,
collection, use, disclosure and verification of any credit, personal or
other information about me at any time from, to or with any credit
reporting agency, credit grantor, or any other person, and I authorize
those parties to give information to you. I understand that all such
information shall be collected, used and disclosed by you, and any of
their affiliates, agents, service providers, successors and assigns to
assess my creditworthiness for this application and my on-going
creditworthiness, for determining my eligibility for any other products or
services to be offered to me and for such other uses not prohibited by
law. The HorizonPlus Credit Card is issued by Peoples Trust, a Principal
Member of MasterCard®. By signing this application, I agree to abide and
be bound by the terms and conditions of the Credit Card Agreement which
HorizonPlus / Peoples Trust will send to me (as amended or restated from
time to time). I agree that you may open a HorizonPlus MasterCard®
account
in my name (“Account”), issue me a card(s), Personal Identification Number
and renewals or replacements from time to time. I agree that if I use my
card or account, I shall be deemed to have requested and received the
card, Account and Credit Card Agreement, and to agree with everything
written in the Credit Card Agreement and this application.
Where
a co-applicant signs this application, we acknowledge the terms of this
application and all consents given in it bind both of us, and all
references to “I” shall mean the applicant and co-applicant individually.
Each applicant and co-applicant, shall be jointly and severally (in
Quebec
,
solidarily) liable for any indebtedness incurred through the use of the
card(s) issued pursuant to this application.
I
may obtain your privacy code or review my options for refusing or
withdrawing my consent, including my option not to be contacted about
offers of products or services by contacting your
Customer
Service
Center
at
1-877-694-6200.
Security
– Cash Collateral
As
security for the performance of all my obligations relating to my credit
card account (“Account”), including repayment of all credit extended
through my Account, I pledge and grant to Peoples Trust Company and to
HorizonPlus Financial Ltd and to their assignees (collectively,
“HorizonPlus”), a first-priority security interest (in Quebec, a movable
hypothec with delivery) in all funds, including interest on such funds,
now or hereafter delivered by me to HorizonPlus (the “Funds”) as of the
date of my delivery of such funds to HorizonPlus. The Funds will be held
in an interest bearing account at Peoples Trust Company (the “Security
Deposit Account”), with interest payable to me annually on the anniversary
of the opening of the Security Deposit Account. Interest rates for the
Security Deposit Account will be shown on my Account statements and are
subject to change. I agree to pay all charges and fees relating to my
Security Deposit Account and the Funds, as disclosed to me from time to
time by Peoples Trust Company. I will not grant any other party any
interest in the Funds. I also understand that my Funds will not be
returned to me until all of my indebtedness with respect to my Account is
fully satisfied, all credit cards have been returned to HorizonPlus and
all of my other obligations have been performed, and in no event will
Funds be returned in less than 4 weeks after receipt of notice of
termination of your account. If I have made a false or misleading material
statement in this application, if I exceed my credit limit, fail to make a
payment when due or otherwise default under the terms of the HorizonPlus
Credit Card Agreement or the security agreement, or if HorizonPlus or I
terminate my Account, HorizonPlus may, without notice to me or demand for
payment, withdraw Funds from the Security Deposit Account and apply such
amounts in satisfaction of any of my obligations with respect to my
Account. If HorizonPlus hires a law firm to enforce its rights with
respect to my Account or the Funds, I agree to pay HorizonPlus all
reasonable legal fees and court costs that HorizonPlus incurs, to the
extent permitted by law.
If
approved, my Account will be charged a one time set up fee of $49.00 plus
$29.00 for each supplemental card, which will be billed on your first
statement. A monthly fee of $5.95 applies plus $2.95 monthly for each
additional card. There is an over-limit fee of $29.00 for each month the
credit limit is exceeded, and a NSF fee of $39.00 for each cheque or other
instrument that is returned unpaid. The annual interest rate on unpaid
balances for purchases is currently 19.5% and accrues from the date the
purchase is posted, if the outstanding balance is not paid in full within
25 days of the statement date. The annual interest rate for cash advances
is 24.5% and accrues from the date the cash advance is made until it is
paid in full. There is a transaction fee of $5.00 for each cash advance.
When the Account is in arrears for more than one month, the annual
interest rate is 24.5% on all balances. These rates and fees are subject
to change with notice. The minimum cash deposit required is $500.00 and
the maximum cash deposit accepted is $10,000.00.
